Welcome to RZR Management Services Statutory Trust (“Site”). RZR Management Services Statutory Trust (“RZR” “we,” “us”) respects the privacy of all Site users. The following Privacy Statement/Terms of Use apply when you view or use the Site by accessing the Site on a computer or other access device and explain how we collect, use, and disclose your personal information.   1. Collection of Personal Information
  2. We collect the following categories of personal information about you:

    • Personal details: When you create your RZR account, we collect your contact information, such as your email address, and authentication information for your login, such as a password. Depending on how you subsequently set up your account and which features you use, we also collect one or more of the following: first and last name, phone number, postal address, and other identifiers you provide to us. If you subscribe to an ad supported subscription plan, we also collect gender and date of birth.
    • Payment details: We DO NOT collect your payment details, and other information to process your payments, including your payment history, billing address, and gift cards you have redeemed.
    • RZR account/profile information: We collect information that is associated with your RZR account and/or profiles on your account, and choices in connection with your use of the RZR service.
    • Usage information: We collect information about your interaction with the RZR service and other information about your use and interaction with the RZR service.
    • Advertising information: If you subscribe to an ad supported subscription plan, we collect information about the ads that you view or interact with, device information, IP addresses, and information about your likely interests. We may use this information to display advertisements to you in the RZR service.
    • Device and network information: We collect information about your computer or other RZR capable devices you might use to access our service, such as smart TVs, mobile devices, set top boxes, and other streaming media devices, your network, and network devices.
    • Communications: If you communicate with us, engage in our surveys or feedback requests, we collect the contents of such communications. We also collect details of communications that we send you and information about your interaction and engagement with these communications.
    • Third Party Products and Service Use: We may collect personal information about you from third parties whose services you use to access or interact with the RZR service such as vendors, agents, and contractors that collect or provide personal information to RZR in connection with services they perform on our behalf including general geographic location based on your IP address in order to customize our service and information to secure our systems, prevent fraud, and help us protect the security of RZR and our users.
    • Publicly available sources such as public posts on social media platforms and other information available through public databases, in accordance with applicable laws.
  3. Use of Personal Information
    • We use your personal information to provide, maintain, improve, and promote the RZR service, and to communicate with you. This involves using the categories of personal information listed above for the following purposes:

    • To provide our service including all features and functionalities, websites and apps, user interfaces, and content and software associated with the RZR service.
    • To administer and operate our business including purposes such as sending transactional communications to you such as confirmation of subscription start date or information about changes to your account, troubleshooting issues, responding to your inquiries and requests, and assisting you with operational requests such as password resets.
    • To research, analyze, and improve our services such as analyzing and understanding our audience to improve our services and optimize RZR content selection and service delivery. This may also include processing your personal information in connection with any surveys you participate in.
    • To enable integrations and promotions to promote the RZR services.
    • To send marketing and informational messages including news and promotional communications about our service, new features and special offers.
    • To operate our ad supported subscription plan including to provide, analyze, administer, enhance, optimize, select, and deliver advertisements.
    • For safety, security, and fraud prevention including to secure our systems, protect our business, and to investigate, prevent, and detect prohibited or illegal activities and other security/technical issues.
    • To comply with law and enforce our Terms of Use including to satisfy applicable law, regulation, legal process, or governmental request, and to protect against harm to the rights, property or safety of RZR, its users or the public, as required or permitted by law, including enforcing this Privacy Statement/Terms of Use.
  4. Disclosure of Personal Information
    • We may disclose your personal information to the following parties:

    • RZR Affiliates: We share your personal information among the RZR affiliates as needed to provide our service; to administer and operate our business; to research, analyze, and improve our services; to enable integrations and promotions; to send marketing and informational messages; to operate our ad supported subscription plan; for safety, security, and fraud prevention; and to comply with law and enforce our Privacy Statement/Terms of Use.
    • Service Providers: We use service providers to perform services on our behalf or to assist us with the provision of services to you. We do not authorize them to use or disclose your personal information except in connection with providing their services. To help maintain the safety and security of our service and users, we and our providers may monitor and record message content to identify harmful behavior, security risks, and violations of our Privacy Statement/Terms of Use and community guidelines.
    • Partners: If you have a relationship with one or more of our partners, we may share certain personal information with them to fulfill your requests in compliance with applicable law. Partners may process your personal information to administer and operate our business; to research, analyze, and improve our services; to enable partner integrations and promotions; and to send marketing and informational messages.
    • RZR marketing providers: When we market RZR on third party services, some of those services, as well as the marketing service providers that we use to purchase, deliver, optimize, or measure our may receive information from us. Common uses of this type of information are to measure the effectiveness and optimize our marketing campaigns RZR uses contractual and technical measures designed to prevent RZR marketing providers from accessing information regarding specific selections you make or URLs you land on.
    • Advertising Companies: If you subscribe to an ad supported subscription plan, we may share certain personal information with advertising companies to facilitate interaction with advertisements, and to measure and improve effectiveness of advertisements.
    • Promotional collaborations: We may collaborate with third parties to offer promotions. To fulfill these types of promotions, we and the third parties may use your personal information to enable partner integrations and promotions; and to send marketing and informational messages.
    • Corporate transactions: In connection with a reorganization, restructuring, merger or sale, or other transfer of assets, we will transfer personal information provided the receiving party agrees to respect your personal information in a manner that is consistent with this Privacy Statement/Terms of Use. We may disclose your personal information in such instances to provide our service; to administer and operate our business; to research, analyze, and improve our services; to enable partner integrations and promotions; to send marketing and informational messages; to operate our ad supported subscription plan; for safety, security, and fraud prevention; and to comply with law and enforce our Terms of Use.
    • Safety, security and fraud prevention: RZR and its service providers may disclose your personal information to third parties where we reasonably believe disclosure is needed for the purpose of safety, security, and fraud prevention.
    • Compliance with law and enforcing our Terms of Use: We may disclose your personal information as necessary to comply with applicable law, regulation, legal process, or governmental request, and processing necessary to protect against harm to the rights, property or safety of RZR, its users or the public, as required or permitted by law.
  5. International Transfers of Personal Information

RZR operates from various countries around the world, as do its service providers, Partners, and other third parties to whom we may need to disclose your personal information, as described above. This means that when you use or interact with RZR, your personal information may be transferred to other countries that have different data protection laws than those where you reside. However, whenever we transfer personal information to other countries, we ensure that the personal information is transferred in accordance with applicable data protection laws and this Privacy Statement.

  7. Your Privacy Rights
    • You have a right to confirm whether we process your personal information and to access and receive a copy of the personal information we process about you. You may also correct or update out-of-date or inaccurate personal information or request that we delete personal information that we hold about you.     • You can object to or request that we restrict processing of your personal information. If we have collected and are processing your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.     • You may have a right not to be subject to a decision made solely using automated means, where such decision would have a legal effect on you or produce a similarly significant effect. You can exercise the rights described above when we receive a verified request in accordance with applicable law.
    • Right to Deletion. All users, regardless of region, and notwithstanding anything herein to the contrary, have a right to deletion of your personal information, subject to exceptions under applicable laws. You may request that all user data that has been collected or stored be deleted by contacting us at: support@reizor.com
  8. Communication and Marketing Preferences
  9. If you no longer want to receive certain communications from us via email or text message, please support@reizor.com. Some third party services allow us to reach users with online marketing about RZR by sending privacy protected contact information to the third party. Privacy protected contact information means we use deidentification technologies to convert the original contact information into a value to keep the original information from being revealed. The third party compares RZR’s privacy protected contact information with privacy protected contact information in its own database and there will be a match only if you have used the same contact information with RZR and the third party. If there is a match, RZR can then choose whether or not to send RZR marketing to you on that third party service, and can optimize and better measure the effectiveness of such marketing.   10. Advertising Choices
  11. If you subscribe to an ad supported subscription plan, we can present you with advertisements, including behavioral advertisements. If you do not want to be presented with behavioral advertisements, you can indicate your choices by support@reizor.com. When you choose to opt out of receiving behavioral advertisements, you will still see Advertisements, but they will not be behavioral advertisements. If you opt out, we may still collect and use the information for other purposes.

  12. Access to Account and Profiles
    • As a RZR member, if you share your account with others in your household, please ensure that they are aware of and have read this Privacy Statement/Terms of Use. This Privacy Statement/Terms of Use applies to their use of RZR services. Please note that the member controls the RZR account and all profiles, the information in the account and all profiles, and whether to share (or stop sharing) the account with individuals in their household.
    • Profiles: Profiles allow users on a RZR account to have a personalized experience, built around the RZR content of interest to them, as well as separate histories. Please note that profiles are available to everyone who uses your account, so that anyone with access to your account can navigate to and use, edit or delete profiles, and information within or associated with the profile. You should explain this to others with access to your account.
    • Profile Transfers: The profile transfer feature on your account allows you and users with access to your account to transfer an eligible profile from your account to a separate account.
    • Account Login Features: You may have the option to use certain account login features, such as email-based or text message-based login, or easier login to the RZR app on certain devices. Please note that any device that is logged into your account will remain logged in unless you log out of those devices.
  13. Cookies and Internet Advertising
  14. We, our service and network providers and advertising companies use cookies, other similar technologies, and resettable device identifiers for various reasons. Cookies are small data files that are commonly stored on your device when you access websites and online services. We use other technologies such as browser storage and plugins. Like cookies, these other technologies may store small amounts of data on a device. Pixel tags often work in conjunction with cookies. In many cases, declining cookies will impair the effectiveness of pixel tags associated with those cookies. If you use the RZR app on a mobile device, tablet, or streaming media device, we may collect a resettable device identifier from your device. Resettable device identifiers can be used like cookies and are found on many mobile devices and tablets, and certain streaming media devices. Like cookies, resettable device identifiers are used to make online advertising more relevant, and for analytics and optimization purposes.

  15. RZR Use These Technologies
  16. We use these types of technologies for various reasons, including to provide our service, to administer and operate our business, to research, analyze and improve our services, to send marketing and informational messages, to operate our ad supported subscription plan; for safety, security and fraud prevention; and to comply with law and enforce our Privacy Statement/Terms of Use. These technologies enable the collection of personal information. We use pixel tags in our emails to understand how members interact with our services. Our use of pixel tags helps us understand when links within messages are clicked, or the emails are opened. RZR uses resettable device identifiers to display marketing for our service or content on third party services, and to operate our ad supported subscription plan, including delivering advertisements to you.

  17. Your Technologies Options
    • Choice regarding cookies
    • For more information about cookies set through our service and to exercise choices regarding cookies, see reizor.com. We do not currently respond to web browser “do not track" signals.

    • Choice regarding resettable device identifiers
    • To exercise choice regarding RZR’s use of resettable device identifiers, please configure the appropriate setting on your device. If you choose not to allow this, you may still see marketing messages promoting RZR on that device but it will not be selected based on the use of a resettable device identifier. Note that your choice regarding the resettable device identifier is specific to that device.

    • To exercise choice regarding other similar technologies
    • In addition to any choices offered in the RZR service, there are several ways to exercise choice regarding technologies that are similar to cookies, such as browser storage and plugins. For example, many popular browsers provide the ability to clear browser storage, typically in the settings or preferences area. See your browser's help function or support area to learn more. In addition to these choices, if you subscribe to an ad supported subscription plan and want to exercise your choices for behavioral advertising, please email support@reizor.com.

  18. Security
  19. We use reasonable administrative, logical, physical, and managerial measures to safeguard your personal information against loss, theft, and unauthorized access, use and modification. These measures are designed to provide a level of security appropriate to the risks of processing your personal information. Unfortunately, no measures can be guaranteed to provide 100% security. Accordingly, we cannot guarantee the security of your personal information.

  20. Retention of Personal Information
  21. We may retain personal information as required or permitted by applicable laws and regulations, including to honor your choices, for our billing or records purposes, and as otherwise necessary to fulfill the purposes described in this Privacy Statement/Terms of Use.

    Specifically, we retain personal information for as long as necessary to provide our service; to administer and operate our business; to research, analyze, and improve our services; to operate our ad supported subscription plan; for safety, security, and fraud prevention; and to comply with law and enforce our Privacy Statement/Terms of Use. Our retention of personal information is based on many factors such as your relationship with RZR, the nature of the personal information, our legal obligations, and the need to defend or resolve current or anticipated legal claims. We take reasonable measures to destroy or de-identify personal information in a secure manner when it is no longer required.

  22. Other Websites, Platforms and Applications
  23. We may use, be provided through features operated by third party platforms, or offer links to sites operated by third parties. In addition, you may encounter third party applications that interact with the RZR services. These platforms have separate privacy statements, notices, and terms of use, which we recommend you review. We may provide support for the RZR service. Information that you post or make available on such sites and forums may be publicly available, unless otherwise noted on the site or forum.

  24. Kids
  25. You must be at least 18 years of age or older to use the RZR service. Children under this age may only use the service with the involvement, supervision, and approval of a parent or legal guardian.

  26. Changes to this Privacy Statement/Terms of Use
  27. We will update this Privacy Statement/Terms of Use from time to time in response to changing legal, regulatory, or operational requirements. We will provide notice of any such changes as required by law. Your continued use of the RZR service after any such updates take effect will constitute acknowledgement and acceptance of those changes. If you do not want to acknowledge or accept any updates to this Privacy Statement/Terms of Use, you may cancel your account.

  28. Supplemental Disclosures for US Residents
  29. These disclosures apply to residents of US states that have adopted comprehensive consumer privacy laws that are in effect (“US State Privacy Laws”). These disclosures supplement the Privacy Statement/Terms of Use.

  30. Notice to California Residents/Notice at Collection
  31. At or before the time of collection, the California Consumer Privacy Act (“CCPA”) requires that we provide a notice of our practices, including the categories of personal information collected, the purposes for which such information is collected or used, whether such information is “sold” or “shared”, and the criteria used to determine how long such information is retained. We have provided these details throughout this section of the Privacy Statement/Terms of Use.

  32. Personal Information We Collect
  33. We collect or have collected in the preceding twelve months, the following categories of personal information from consumers:

    • Identifiers such as name, email address, password, payment details, postal address, and information about your RZR account and/or RZR profiles on your account. We also collect IP addresses, identifiers from the devices you might use to connect, cookie identifiers, and characteristics about the networks you use when you connect to our service.
    • Additional categories of information listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)) (“California Customer Records”) such as name, address, phone number, credit card or debit card number, and other payment details.
    • Characteristics of protected classifications under California or federal law (“characteristics of protected classifications”) such as date of birth and gender if you subscribe to an ad supported subscription plan.
    • Commercial information such as your purchase history and other products purchased or considered.
    • Internet or other electronic network activity information (“internet activity information”) such as any information about your interactions with RZR, our service providers, or partners, including choices you have made when engaging with interactive titles, or search queries on the RZR service. When you subscribe to an ad supported subscription plan we receive information provided by advertising companies such as information about your likely interests they have collected or inferred from your visits to other websites and apps.
    • Geolocation data such as your general location based on your IP address (such as your city, state/province, and postal code).
    • Inferences we may make using the categories of personal information above in the context of the RZR service.
    • Sensitive personal information such as a RZR username in combination with the password.
  34. Categories of personal information disclosed for a business purpose
  35. We disclose and have disclosed in the past twelve months, the following categories of personal information for business purposes: identifiers, California Customer Records, characteristics of protected classifications, commercial information, internet activity information, geolocation data, audio/visual information and inferences. We disclose these categories of personal information to the following recipients and entities engaged in connection with promotional collaborations, corporate transactions, safety, security and fraud prevention, or for purposes of compliance with law and enforcing our Privacy Statement/Terms of Use.

  36. Categories of Personal Information Sold or Shared
  37. We engage in the sale and sharing and also have sold or shared (as defined under CCPA) the following categories of personal information in the last 12 months:

    Categories of personal information “sold”: Our use of identifiers for RZR marketing activities may be considered a “sale” under CCPA. Additionally, we use identifiers for marketing activities (such as behavioral advertisements promoting the RZR service or RZR content through use of cookies and resettable identifiers) which can be considered “sharing” under CCPA.

    Categories of personal information used for “targeted advertising” (considered “sharing” under CCPA) in the context of our ad supported subscription plan: identifiers and geolocation data (for example, Advertisers may select Advertisements to be displayed to devices in a specific city or state). We allow Advertisers to use these categories of personal information to deliver Advertisements on the RZR service. Such use may be considered "sharing" under CCPA. We engage in the sale and sharing and also have sold or shared (as defined under CCPA) the above categories of personal information for the following business or commercial purposes: to send marketing messages, and operate our ad supported subscription plan.

  38. Retention of Personal Information
  39. We may retain personal information as required or permitted by applicable laws and regulations, including to honor your choices, for our billing or records purposes, and to fulfill the purposes described in this Privacy Statement/Terms of Use. Specifically, we retain personal information for as long as necessary to provide our service; to administer and operate our business; to research, analyze, and improve our services; to operate our ad supported subscription plan; for safety, security, and fraud prevention; and to comply with law and enforce our Terms of Use. Our retention of personal information is based on many factors such as your relationship with RZR; the nature of the personal information; compliance with our legal obligations; and/or defending or resolving actual or anticipated legal claims. We take reasonable measures to destroy or de-identify personal information in a secure manner when it is no longer required.

  40. Your California Privacy Rights
  41. California residents have certain rights with respect to your personal information.

    • Right to Know/Access. You have the right to request that we disclose: the categories and specific pieces of personal information we have collected about you; the categories of sources from which personal information are collected; our business or commercial purpose for collecting, using, disclosing, selling or sharing personal information; the categories of third parties to whom we disclose, sell, or share personal information; and the categories of personal information we have disclosed, sold, or shared about you for a business or commercial purpose. You also have a right to confirm whether we process your personal information, and to access and receive a copy of the specific personal information we have collected about you.
    • Right to Correction. You have a right to request correction of any inaccurate personal information we hold about you.
    • Right to Deletion. You have a right to request deletion of your personal information, subject to exceptions under applicable laws.
    • You can assert these rights above when we receive a verified request from you. As of the date of this Privacy Statement, we may use certain categories of personal information to offer members an ad supported subscription plan or engage in RZR marketing activities. Under the CCPA, these activities may be considered “selling” or “sharing.” If you do not want us to sell or share personal information about you, you can learn how to make applicable choices by support@reizor.com. We do not knowingly sell or share (as defined by the CCPA) the personal information of minors under 16 years of age.

      Some web browsers and extensions are compatible with Global Privacy Control (GPC), allowing them to communicate your preference to opt out from specific forms of data processing, including any “sale” or “sharing” of personal information. In California, we honor your choices expressed through the GPC settings if we detect such a signal, as required by applicable law.     • Right to Limit the Use of Sensitive Personal Information. As described above, we do collect sensitive personal information such as your RZR username, password, and payment details, which could be considered types of “sensitive personal information.” However, we use these types of sensitive personal information only for the purpose of providing our service; administering and operating our business; and other permitted purposes as described in the Privacy Statement/Terms of Use and not for a purpose which would require offering a choice to limit its use under the CCPA.
    • Authorized Agents. You have the right to exercise the rights described in this section using an authorized agent acting on your behalf. They can submit a request on your behalf to support@reizor.com. along with a statement, certifying as may be required, that the agent is authorized to act on your behalf. In order to verify the request, we may ask you to verify your identity and your authorization of the agent to make requests on your behalf.     • Right to Non Discrimination. You have a right not to be subject to discriminatory treatment for exercising any of your rights described under this section. We will not discriminate against you based on your exercise of any of your rights.
    • Notice of Financial Incentives When you subscribe to RZR you may choose an ad supported subscription plan. It is possible that some may interpret an ad supported subscription plan to fall within the meaning of a “financial incentive” for the purposes of the CCPA. Please see reizor.com
  42. Personal Information Rights under US State Privacy Laws
  43. This section applies to residents of US States outside of California that have adopted US State Privacy Laws.

  44. Sale and Use of Personal Information for Targeted Advertising Purposes
  45. We may use certain categories of personal information to offer members an ad supported subscription plan or engage in marketing activities as described above in this Privacy Statement/Terms of Use. Some of these activities may be considered “selling” or “targeted advertising” under US State Privacy Laws depending on how you interact with us and the choices you make.

Using these choices will not opt you out of the use of previously sold personal information or stop all behavioral advertising. In some US states, we may honor your choices expressed through Global Privacy Control (GPC) signals as required by applicable law.   46. Use of De-Identified Information
  47. We may de-identify personal information in a secure manner when we determine it is appropriate as part of our business operations. We take reasonable measures to maintain and use the information in a de-identified manner. We do not attempt to re-identify such information, except as permitted under applicable law.

  48. Other Personal Information Rights under US State Privacy Laws
  49. To the extent applicable under US State Privacy Laws, you may have the following rights in connection with your personal information:

    • A right to confirm whether we process your personal information and to access and receive a copy of the personal information we have collected about you.
    • A right to request deletion of your personal information, subject to exceptions under applicable US State Privacy Laws.
    • A right to request correction or update any inaccurate personal information we hold about you.

  50. Use of Authorized Agents
  51. If you are a resident of a US state that gives you a right to use an authorized agent, they can submit a request on your behalf to support@reizor.com along with a statement, certifying as may be required, that the agent is authorized to act on your behalf. In order to verify the request, we may ask you to verify your identity and your authorization of the agent to make requests on your behalf.   52. Appeals
  53. If you are a resident of a US state that gives you a right to appeal a decision, you may appeal our decision denying your request. Requests to change our policies or practices are not grounds for appeal. You may request an appeal by contacting us at support@reizor.com. Please provide the US state that you are writing from, accompanied with documentation regarding the decision you are appealing.

  54. Copyright Complaints and Copyright Agent
  55. A. Termination of Repeat Infringer Accounts. RZR ST respects the intellectual property rights of others and request that the users do the same. Pursuant to 17 U.S.C. § 512(i) of the United States Copyright Act, as amended, RZR ST has adopted and implemented a policy that provides for the termination in appropriate circumstances of users of the Site who are repeat infringers. RZR ST may terminate access for participants or users who are found repeatedly to provide or post protected third-party content without necessary rights and permissions.

    B. DMCA Take-Down Notices. If you are a copyright owner or an agent thereof and believe, in good faith, that any materials provided on the Site infringe upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act (see 17 U.S.C § 512) (“DMCA”) by sending the following information in writing to the designated copyright agent at Copyright Agent at support@reizor.com:

    • The date of your notification
    • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
    • A description of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site
    • A description of the material that is claimed to be infringing or to be the subject of infringing activity and information sufficient to enable us to locate such work
    • Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and/or email address
    • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
    • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

    C. Counter-Notices. If you believe that your User Content that has been removed from the Site is not infringing, or that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to post and use the content in your User Content, you may send a counter-notice containing the following information to the copyright agent using the contact information set forth above:

    • Your physical or electronic signature;
    • A description of the content that has been removed and the location at which the content appeared before it was removed
    • A statement that you have a good faith belief that the content was removed as a result of mistake or a misidentification of the content; and
    • Your name, address, telephone number, and email address, a statement that you consent to the jurisdiction of the federal court in Wyoming and a statement that you will accept service of process from the person who provided notification of the alleged infringement.

    If a counter-notice is received by the copyright agent, RZR ST may send a copy of the counter-notice to the original complaining party informing such person that it may reinstate the removed content in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member or user, the removed content may (in the discretion of RZR ST) be reinstated on the Site in 10 to 14 business days or more after receipt of the counter-notice.

  56. License Grant
  57. By posting any User Content via the Site, you expressly grant, and you represent and warrant that you have a right to grant, to us a royalty- free, sublicensable, transferable, perpetual, irrevocable, non-exclusive, worldwide license to use, reproduce, modify, publish, list information regarding, edit, translate, distribute, publicly perform, publicly display, and make derivative works of all such User Content and your name, voice, and/or likeness as contained in your User Content, if applicable, in whole or in part, and in any form, media or technology, whether now known or hereafter developed, for use in connection with the Site.

  58. Proprietary Rights
  59. You acknowledge and agree that the Site contains proprietary information that is protected under U.S. and international intellectual property laws, including the laws of copyright and trademark. Except as expressly authorized by RZR ST or our licensors, you agree not to sell, rewrite, modify, redistribute, create derivative works from the Site content in whole or in part. You may look at the Site online, download individual pages to your personal or handheld computer for later reading, and even print a copy of pages for yourself. You may not remove any copyright notices from RZR ST materials. RZR ST reserves all of its other rights not granted in these Terms of Use. You agree not to access the Site by any means other than through the interface that is provided by RZR ST for use in accessing the Site. Other product and company names that are mentioned on the Site may be trademarks of their respective owners. RZR ST reserves all rights that are not expressly granted to you under this Agreement.

  60. No Warranties; Release

RZR ST MAKES NO EXPRESS OR IMPLIED WARRANTIES, COVENANTS OR REPRESENTATIONS OF ANY KIND WITH RESPECT TO THE SITE, ANY SERVICES OFFERED THEREON, SITE CONTENT, THIRD PARTY CONTENT OR ANY OTHER CONTENT. RZR ST EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, WITH REGARD TO THE SITE, THE SERVICES OFFERED THEREON, THE SITE CONTENT, THIRD PARTY CONTENT AND ANY OTHER CONTENT, AND ANY PRODUCT OR SERVICE FURNISHED OR TO BE FURNISHED FROM OR ON THE SITE. WE DO NOT WARRANT: THAT THE FUNCTIONS PERFORMED BY THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE; OR THAT DEFECTS IN THE SITE WILL BE CORRECTED; OR THE ACCURACY OR COMPLETENESS OF THE SITE CONTENT, THIRD PARTY CONTENT, OR ANY OTHER CONTENT; OR THAT ANY ERRORS IN THE SITE CONTENT, THIRD PARTY CONTENT OR OTHER CONTENT WILL BE CORRECTED. THE SITE, THE SERVICES OFFERED THEREON, AND THE SITE CONTENT AND OTHER CONTENT ARE PROVIDED ON AN “AS IS”, “WHERE IS”, “AS AVAILABLE” AND “WITH ALL FAULTS” BASIS. SOME STATES DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE FOREGOING DISCLAIMER MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE. IN NO EVENT WILL RZR ST BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO ANY DIRECT, INDIRECT, GENERAL, SPECIAL, COMPENSATORY, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR OTHER DAMAGES ARISING OUT OF (I) YOUR CONDUCT IN CONNECTION WITH USE OF THE SITE, THE SERVICES OFFERED THEREON OR THIS AGREEMENT (II) INABILITY TO USE THE SITE OR THE SERVICES OFFERED THEREON, THE SITE CONTENT OR ANY OTHER CONTENT, (III) ANY TRANSACTION CONDUCTED THROUGH OR FACILITATED BY THE SITE; (IV) ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS, OR OTHER INACCURACIES IN THE SITE, THE SERVICES, THE SITE CONTENT AND/OR ANY OTHER CONTENT, (V) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR INFORMATION, OR DATA, OR (VI) ANY OTHER MATTER RELATING TO THE SITE, THE SERVICES OFFERED THEREON OR ANY OTHER CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOU ARE DISSATISFIED WITH THE SITE, THE SERVICES, SITE CONTENT OR ANY OTHER CONTENT, OR WITH THE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO CEASE USING THE SITE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, AND THEREFORE SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH STATES THE SITE’S LIABILITY IS LIMITED AND WARRANTIES ARE EXCLUDED TO THE GREATEST EXTENT PERMITTED BY LAW, BUT SHALL, IN NO EVENT, EXCEED ONE HUNDRED DOLLARS ($100.00).

    NOTWITHSTANDING THE FOREGOING, FEDERAL AND STATE SECURITIES LAWS IMPOSE LIABILITIES UNDER CERTAIN CIRCUMSTANCES ON PERSONS WHO ACT IN GOOD FAITH, AND THEREFORE NOTHING HEREIN SHALL IN ANY WAY CONSTITUTE A WAIVER OR LIMITATION OF ANY RIGHTS WHICH THE READER MAY HAVE UNDER FEDERAL OR STATE SECURITIES LAWS.

    IF YOU HAVE A DISPUTE WITH RZR ST, YOU RELEASE RZR ST (AND ITS MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, CONSULTANTS AND AGENTS) FROM CLAIMS, DEMANDS AND DAMAGES (ACTUAL AND CONSEQUENTIAL) OF EVERY KIND AND NATURE, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH DISPUTE. YOU AGREE TO INDEMNIFY AND HOLD RZR ST (AND ITS MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, CONSULTANTS, AND AGENTS), HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING ATTORNEY FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF (A) YOUR BREACH OF THIS AGREEMENT, OR YOUR VIOLATION OF ANY LAW OR THE RIGHTS OF A THIRD PARTY (B) YOUR USE, MISUSE, OR INABILITY TO USE THE SITE, THE SERVICES, OR THE SITE CONTENT OR ANY VIOLATION BY YOU OF THIS AGREEMENT. YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT RZR ST IS NOT LIABLE FOR ANY CONDUCT OF ANY USER OF THE SITE.

  62. General Terms
  63. If any part of this Agreement is held invalid or unenforceable, that portion of the Agreement will be construed consistent with applicable law. The remaining portions will remain in full force and effect. Any failure on the part of RZR ST to enforce any provision of this Agreement will not be considered a waiver of RZR ST rights to enforce such provision. RZR ST rights under this Agreement will survive any termination of this Agreement. Any cause of action related to or arising out of your relationship with RZR ST must commence within ONE year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

  64. Laws that Govern this Agreement
  65. RZR ST controls the Site from its offices within the State of Wyoming in the United States of America. The Site can be accessed from any of the United States and from other countries worldwide. Since the laws of each State or country able to access the Site may differ, by accessing the Site, you and RZR ST agree that the statutes and laws of the State of Wyoming, without regard to choice of laws principles, will apply to all matters relating to use of the Site. No waiver of any of these Terms of Use shall be deemed a further or continuing waiver of such term or any other term. RZR ST does not make any representation that materials made available through the Site are appropriate or available for use in other locations and accessing them from territories where their contents are illegal is prohibited. Those who choose to access the Site from other locations do so on their own initiative and are responsible for compliance with local laws.

    RZR ST may assign or delegate these Terms of Site and/or our Privacy Policy, in whole or in part, to any person or entity at any time with or without your consent. You may not assign or delegate any rights or obligations under the Terms of Site or Privacy Policy without RZR ST prior written consent, and any unauthorized assignment and delegation by you is void.

  66. Cancellation/Admittance
  67. All sales are final. No refunds, exchanges or cancellations are permitted. Credit card used at purchase must be presented, along with valid photo ID by cardholder upon event entry or entry will be denied. All guests must arrive together and additional party members will not be allowed to check in on behalf of cardholder. Guests must check in before 12 am (midnight) or table may be released to other guests. All guests must be 21 years of age with valid ID. All guests must adhere to dress code and all venue rules, with management reserving all rights thereunder.

  68. Tickets
  69. You must purchase all tickets from us. Free tickets are nontransferable and may not be sold to any third party. Free ticket winners will be randomly selected by computer from all ticket purchasers participating in a particular event. The benefit level of any participant will not guarantee any discounted or free tickets to any individual for any particular event.
